This document contains the General Conditions of Sale governing the purchase of products through the website at www.technocases.it, hereinafter also referred to as the "Site".
The Seller of the products present on the online catalog of the site www.technocases.it is New Works Webtech s.r.l. with registered office in via San Gregorio 44, 20124 Milan (Italy) and operative office in Viale Lombardia, 29 - 22032 Albese con Cassano (CO) - (Italy) (VAT No. and Tax Code: 02658930132). As far as the production, preparation and packaging of the Products purchased on the Site are concerned, they are intended to be carried out by Technopartner SRL. As a result of the above, every product purchased on the Site is sold directly by New Works. New Works may modify the terms of sale at any time. The new conditions of sale will be effective from the moment of their publication on the Site.
This agreement between the Seller and the Customer shall be deemed concluded when the Seller sends the order confirmation to the Customer according to the terms and conditions indicated in the following Article. The conclusion of the contract implies that the Customer has read and fully accepted these General Conditions of Sale. If the Customer is a consumer, once the online purchase procedure is concluded, he/she will print or save an electronic copy and in any case keep these General Conditions of Sale, in compliance with the provisions of the regulations on distance sales. If the Customer does not intend to accept the General Conditions of Sale, he/she must not proceed with the order at the end of the purchase process on the Site. The availability of the Products present on the Site is to be intended as normally communicated on the Site itself. However, with his Order the Customer also accepts a partial delivery of the Products ordered. In the event of partial delivery of the Products, the Seller will refund the Customer the amount already paid corresponding to the value of the unfulfilled Products.
The Seller reserves the right not to process orders already accepted if there are not sufficient security conditions and guarantees relating to payments made online or if the information and data provided by the customer are incomplete and / or insufficient for the order.
The Customer can only purchase the Products present on the Site at the time the order is placed and viewable online at www.technocases.it, as described in the relevant information sheets. The order will be validly processed at the time of receipt on the mailbox communicated by the customer of the confirmation of payment of the order itself.
The correct receipt of the order is confirmed by the Seller by means of an email response, sent to the email address provided by the customer. This confirmation message will contain a Customer order number to be used in any further communication with the Seller. The message contains all the data entered by the Customer, all the information relating to the essential characteristics of the Products purchased, the price, the payment methods and methods and costs of delivery. The Customer will have to verify the correctness and communicate promptly any corrections to customer service, according to the procedures described in this document. In case of non-acceptance of the order, the Seller guarantees timely communication to the Customer. The Seller purchases directly from the Supplier every Product available on the Site.
The products will be sold at the list prices in force at the time of the order by the Customer and without delivery costs, which will be counted at the time of the order.
All prices indicated for products available on www.technocases.it intended for countries belonging to the European Union are to be understood as inclusive of VAT.
All prices indicated for products available on www.technocases.it intended for countries outside the European Union don’t include VAT and don’t include any import duties and taxes.
Shipping prices include VAT.
It is possible to exercise the right of withdrawal on Products purchased on the Site without any penalty and without specifying the reason, by returning to the Seller all or part of the Products purchased. The will to exercise the right of withdrawal must be manifested within the term of 15 days, starting from the day in which the Customer or an agent of the same (other than the courier) has acquired possession of the Products.
Within 14 (fourteen) days from the date on which the Customer communicates his decision to withdraw from the Contract, the Customer must send the duly packaged Products to the Seller by a courier chosen by the Customer himself.
However, it is understood that in the event that the products purchased do not comply or have defects, the customer will have the right to request replacement of the same as indicated in the following paragraph "Non-conforming Products".
From the moment the Customer places an order on the Site, the time required for the preparation and shipment of the Products depends on their availability. On the site is indicated the availability of each product and the approximate time of order processing. If during the processing of an order one or more products are no longer available, because they are out of stock or unavailable, the Seller will inform the customer with an e-mail, the order will be updated with the elimination of unavailable products. The available Products will be shipped and the amount related to the unavailable Products will be automatically deducted from the total amount indicated during the purchase, regardless of the payment method chosen and the Customer will be refunded the value of the Products not shipped. The Seller will do everything possible to ensure that the customer respects the delivery times indicated on the Site.
The Seller undertakes to deliver to the Customer Products identical to those indicated and described in the pages of the site. However, it should be noted that the images of the Products and the Packages present on the site serve the Customer to facilitate the recognition of the products. Variations in the packaging of the Products are possible such that the product delivered, although substantially the same as that purchased, has a different packaging from that presented on the Site. In any case, the characteristics will always be based on the characteristics and indications of use on the label of the Product delivered.
If the products purchased by the customer have defects of conformity with the sales contract, in accordance with the provisions of the law, the customer may request a replacement of the same (Legal Warranty). To obtain the replacement the customer must communicate the discrepancy via e-mail at customercare@technocases.it
Before proceeding with the return of the goods, the Customer must wait for an answer from the Seller through the email address customercare@technocases.it. The Seller will send the Customer the data for the return of the goods.
The Seller will not be able to accept the returned goods for which the Customer has not obtained authorization to return the goods from the Seller. The costs for shipping defective Products to the Seller shall be borne by the Seller. Once the defective Products have been received and the actual discrepancy has been verified, the Seller will replace the Products by sending them to the Customer at his own expense. In the event that the products declared non-conforming by the customer should be in accordance with the order, the Seller will notify the customer that the return procedure can not be completed. In this case, the Seller will not send the Customer the replacement Products: the Customer, within 30 days, will have to pick up the Products at the Seller's expense.
This contract is governed by Italian law for the solution of civil and criminal disputes arising from the conclusion of this contract, if the customer is a consumer, the territorial jurisdiction is that of the reference hole of his town of residence.
